Limitations of the AD Model Builder evaluation version.

The evaluation version is identical to the commercial version with some limitations on the size of the problem which can be handled. Also some banners are printed out in executables made with this version announcing that this is an evaluation version. Finally, you are not permitted to distribute executables made with the evaluation version.

License Agreement & Registration

IMPORTANT -- READ CAREFULLY: This License Agreement is a legal agreement between you (either an individual or a single entity) and Otter Research Ltd., for the software product AD Model Builder demonstration version for Redhat Linux 6.1 which includes computer software and may include associated media, printed material, and online or electronic documentation ("SOFTWARE PRODUCT"). By installing, copying, downloading, or otherwise using the SOFTWARE PRODUCT, you agree to be bound by the terms of this License Agreement. If you do not agree to the terms of this License Agreement, do not download, install or use the SOFTWARE PRODUCT.

Otter Research Ltd’s SOFTWARE PRODUCT LICENSE AGREEMENT

Subject to the following terms and conditions, Otter Research Ltd. grants to you, and you hereby accept, a personal nonexclusive license to use the Otter Research Ltd’s SOFTWARE PRODUCT. The SOFTWARE PRODUCT is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The SOFTWARE PRODUCT is licensed, not sold.

1. GRANT OF LICENSE

Otter Research Ltd grants to you the right to use the SOFTWARE PRODUCT on one (1) computer at your premises solely for personal evaluation of the SOFTWARE PRODUCT and test its compatibility with other products. You may move the SOFTWARE PRODUCT from one computer to another, so long as you can ensure that there is no possibility that the SOFTWARE PRODUCT is used on more than one (1) computer. You may also store or install a copy of the SOFTWARE PRODUCT on a storage device, such as a network server, used only to install or run the SOFTWARE PRODUCT on one (1) of your other computers over an internal network solely to evaluate the SOFTWARE PRODUCT and test its compatibility with other products. You may not sell, give away, or in any other way distribute, compiled executeables made with the SOFTWARE PRODUCT.

2. OTHER RIGHTS AND LIMITATIONS

TRANSFER: The SOFTWARE PRODUCT may be transferred to another party, provided you retain no copies, only if the other party accepts the terms and conditions of this license agreement. At the time of the transfer of the SOFTWARE PRODUCT, you must at the same time transfer all disks and documentation including any updated disks and documentation.

RESTRICTIONS: You may not distribute, lease, sublease. rent, or sublicense the SOFTWARE PRODUCT without written permission of Otter Research Ltd. You may not reverse engineer, decompile, or disassemble the SOFTWARE PRODUCT, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation. You may not sell, give away, or in any other way distribute, compiled executeables made with the SOFTWARE PRODUCT.

3. COPYRIGHT

The SOFTWARE PRODUCT is copyrighted and protected by international treaty provisions. You may not use, copy, modify, or transfer the software or related documentation or any copy except as expressly provided in the license agreement or with written permission of Otter Research Ltd.

LIMITED WARRANTY

NO WARRANTIES: Otter Research Ltd. expressly disclaims any warranty for the SOFTWARE PRODUCT. The SOFTWARE PRODUCT and any related documentation is provided "as is" without warranty of any kind, either express or implied, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, or noninfringement. Due to the inherent complexity of computer programs and mathematical models, the SOFTWARE PRODUCT and your mathematical models may not be completely free of errors. You are advised to verify your answers before basing decisions on them. NEITHER OTTER RESEARCH LTD NOR ANYONE ASSOCIATED WITH THE CREATION, PRODUCTION, OR DISTRIBUTION OF THE SOFTWARE PRODUCT MAKES ANY OTHER EXPRESSED WARRANTIES REGARDING THE DISKS OR DOCUMENTATION AND MAKES NO WARRANTIES AT ALL, EITHER EXPRESSED OR IMPLIED, REGARDING THE SOFTWARE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR OTHERWISE. The entire risk arising out of use or performance of the SOFTWARE PRODUCT remains with you.

REMEDY: In no event shall Otter Research Ltd be liable for any damages including but not limited to loss of profit, data, or direct, indirect, incidental, special or consequential damages, even if Otter Research Ltd has been specifically advised of the possibility of such damages.

GENERAL: If any provision of this License Agreement is determined by a court to be invalid under any applicable statute or rule of law, it shall be deemed omitted and the remaining provisions shall continue in full force and effect. This License Agreement is governed by, and shall be construed in accordance with, the laws of the Province of British Columbia. If this product was acquired outside of Canada, then local laws may apply.
